இந்த விதிமுறைகள் ஆங்கிலத்தில் வெளியிடப்பட்டுள்ளன. விளக்கத்தில் வேறுபாடு ஏற்பட்டால் ஆங்கிலப் பதிப்பே செல்லுபடியாகும். These Terms of Agreement govern your use and access of our Pay&Go services (“Services”) provided by MegaPay (Pvt) Ltd (“we,” “us,” or “MegaPay”). When using or accessing the Services, you consent to be bound by these Terms. Read them carefully.

1. Definitions

For the avoidance of doubt in this Agreement, the following have the following specific meanings:

Access Information: Your private credentials (i.e., password, PIN, biometric details, telephone number) required to access secured areas of the Pay&Go services.

Content: Any item, data, articles, text, images, photos, software, video, audio, or graphics provided through the Services.

Customer: The individual who has signed up for a Pay&Go account or a user of any of the services provided by Pay&Go.

KYC (Know Your Customer): Our mandatory identification and verification process of customers, as required under Sri Lankan law and Central Bank of Sri Lanka (CBSL) rules.

MegaPay: A Fin-tech service provider.

Personal Data: Any information capable of being used to identify you, as defined in applicable data protection legislation.

Services: The services offered via the Pay&Go website, app and kiosks, as outlined in Section 2.

Transaction Limit: Your individual transaction limit, as based on your level of verification, regulatory limits, and discretionary limits imposed by MegaPay.

Trademarks: The “Megapay” name, “Pay&Go” brand name, individual logos, and all related service marks.

2. Our Services & Your Eligibility

2.1 Service Offerings: Pay&Go offers digital payment services. These services are offered on an “as is” and “as available” basis, without any express or implied warranties.

2.2 Account Types & Limits: Basic Account — a limited view of the functions and pages of Pay&Go. Verified Account — mandatory KYC requirements should be passed. Some services and higher transaction limits are available only to Verified Accounts.

2.3 Availability: The services are typically available round the clock, 24/7. We will give advance notice through the app or website of planned maintenance windows that impact availability unless caused by force majeure.

3. Your Responsibilities

3.1 Proper Registration & KYC: Proper and accurate information must be filled when registering. Some transactions need successful KYC verification in terms of CBSL guidelines. Each individual may only have one verified account.

3.2 Account Security: You are solely liable for your Access Information security. You will be liable for all actions performed on your account, authorized or not. Inform us at once in the event of suspected unauthorized use or security breach so we are able to take measures to stop further unauthorized use. Never share OTPs you receive.

3.3 Data Protection: You will not provide Pay&Go data to third parties and will take reasonable steps to protect your account information. By using the Services, you consent to our data practices described in our Privacy Policy. You have rights under applicable law concerning your Personal Data.

3.4 Secure Practices: Practice good security: You agree to never save Access Information as plain text, digitally or in any other form, never share credentials, always use safe networks, log out after each session, keep the app up to date, and report lost/stolen devices promptly.

3.5 Transaction Vigilance: Verify all transaction details before making a payment. Review your transaction history regularly and notify us within 30 days of any discrepancy. We can require further verification on some transactions. You should ensure the payment methods given to us are yours. We shall not be liable for incorrect, mistaken, fraudulent transactions that you have initiated.

3.6 Respect for Others: You will not access another individual’s information or attempt to bypass our security measures.

4. Acceptable Use

To secure the integrity and security of our services, you agree not to:

4.1 Abuse Intellectual Property: Copy, modify, distribute, reverse-engineer, or remove our Trademarks and the Services’ proprietary notices. Our intellectual property shall not be used without permission.

4.2 Participate Prohibited Activities: Use the Services for money laundering, terrorist finance, gambling, adult content, illegal services/goods, tax evasion, or any other act against applicable legislation (including Sri Lankan financial regulations).

4.3 Compromise Systems: Attempt to hack, crack, send malware, execute denial-of-service attacks, or utilize unauthorized automated systems to gain access to the Services.

4.4 Commercial Exploitation: Redistribute, resell, or make derivative works of the Services without our specific prior written consent.

4.5 Abuse Communications: Send spam, harass, or send obscene, threatening, or defamatory materials through the Services.

5. Payments & Financial Terms

5.1 Payment Processing: We accept payment cards of different categories. Payment is made in Sri Lankan Rupees (LKR). Processing time is susceptible to variations with regard to service providers and bank timings. We also accept debit payments through your bank account.

5.2 Transaction Reversal/Refusal: We reserve the right to refuse, cancel, or reverse transactions that are against these Terms or law, lack sufficient funds, are due to technical errors, are suspected to be fraudulent, are disputed by a merchant, or are ruled by regulation or court order. Each transaction will be considered as a fresh case and the decision of MegaPay is final.

5.3 Fees: There can be extra charges for partner services. There is a currency conversion charge on foreign currency converted transactions. We inform you of fees that are applicable for the transaction, before you make the payment. Where you choose to make a payment shown on the screen means that you accept the charges as shown to you at the time of the transaction.

5.4 Disputes: Inform us of transaction disputes within 30 days with documents to support. Certain transactions may not be possible to be reversed and both the Pay&Go account holder and the card/bank account holder are jointly and severally liable for any loss caused in such a case. Reversals are credited in the original payment method unless requested by the card/bank account holder. The investigation time frame depends on complexity.

6. Transaction Processing

6.1 Your Authority: You grant us authority to act on instructions that are in accordance with our verification and security standards. Additional verification may be required for certain transactions.

6.2 Our Processing: We process instructions in a timely manner but delays can occur during peak usage or maintenance. Failed transactions are advised by reason codes.

6.3 Your Liability: You are responsible for ensuring instructional accuracy and adequate funds. You are liable for losses arising from your negligence, unauthorized transactions or fraudulent transactions initiated from your account, or delayed reporting of errors/unauthorized transactions. You will be liable for the transactions initiated from your account notwithstanding anything to the contrary. We will process the instructions provided from your account using the provided account/card information.

7. Security & Compliance

7.1 Prevention of Fraud: We utilize sophisticated systems to avoid fraud and may: screen transactions, freeze accounts to be investigated, require additional verification, or report suspicious activity to the authorities.

7.2 Your Cooperation: You will have to report suspected fraud promptly, assist in investigations, and supply accurate information in verification.

7.3 AML Compliance: All transactions are carefully screened against Anti-Money Laundering (AML) legislation. Large/unusual transactions must be documented. We strictly adhere to CBSL and international AML legislation and supply information to regulators as mandated by legislation.

7.4 Sanctions: We screen transactions against sanctions lists. Accounts may be frozen subject to suspected sanctions violations. You ensure you are not a prohibited person.

7.5 Tokenization: Where you have provided us your card (Visa, Mastercard, etc.) or account information, and the authenticity of the person saving the card information is verified by secondary means, the acquiring bank will tokenize your card information for security. We do not store any of your payment card data. You may request to remove a certain saved account information or tokenized card at any time.

8. Our Rights & Responsibilities

8.1 Service Management: We suspend, modify, or terminate Services on reasonable notice or immediately, include security patches, and specify/set transaction limits. We strive for reasonable availability of Services.

8.2 Account Actions: Your account may be suspended or closed for violation of Terms, suspicious/fraudulent transactions, non-compliance with regulatory requirements, or technical security reasons, with or without notice.

8.3 Monitoring & Records: Communications can be monitored for quality and compliance. Transaction data is retained where necessary by law. Our Privacy Policy governs the retention of data.

9. Data Protection

9.1 Data Use: We collect data needed for the delivery of service and legal compliance, as described in our Privacy Policy. Limited disclosure to third parties is revealed therein. We may use your data for marketing for analytical purposes.

9.2 Security Controls: We use industry standard security controls, including encryption, tokenization and access controls, and regularly conduct audits.

9.3 Your Rights: You have the right to access, edit, delete (where permitted), and assert portability of your Personal Data.

9.4 Retention: We store data as law and business necessitate. Secure destruction procedures are in place.

10. Intellectual Property

10.1 Ownership: MegaPay retains all intellectual property rights in the Pay&Go Services. Your Content is yours, but you grant us a licence to use it so that we can operate and develop services. Third-party IP is respected.

10.2 Your Licence: We grant you a limited, revocable, non-transferable licence to use the Services in accordance with these Terms.

11. Liability & Indemnity

11.1 Service “As Is”: Services are “AS IS” and “AS AVAILABLE.” We disclaim warranties of uninterrupted service, fitness for specific purposes, or third-party performance.

11.2 Limitation of Liability: Our liability is capped at the value of the particular disputed transaction. We disclaim responsibility for indirect, consequential, or punitive damages, third-party default, or force majeure.

11.3 Your Indemnity: You agree to indemnify MegaPay for loss due to your violation of these Terms, Services abuse, negligence, or third-party claims in connection with your action or negligence.

12. Resolving Issues

12.1 Support: 24/7 customer service through multiple channels, with escalation processes. Multi-lingual support where possible.

12.2 Grievances: We aim to resolve grievances internally within 15 business days, in some cases resolutions may take more time. Outstanding grievances can be escalated to the relevant authorities. Written grievances require documentation.

12.3 Resolution of Disputes: Mediation is preferable for qualified disputes. Commercial disputes are to be settled in arbitration.

13. Rules & Updates

13.2 Updating Terms: We shall update the terms and conditions from time to time. Substantial changes may necessitate new consent; you may cancel if you object. You consent to the change of names and identification of a product. You may not proceed to use our services if you do not consent to these terms and conditions.

13.3 Regulatory Amendments: Services can be altered to adapt to new regulations, temporary suspension being a solution if necessary. Significant compliance-related alterations will be communicated to customers at the discretion of MegaPay.

14. General Terms

14.1 Governing Law: These Terms are subject to the Sri Lanka law. Disputes fall under the jurisdiction of Sri Lankan courts, subject to consumer protection laws applicable.

14.2 Lawful Terms: If one provision is not lawful, the others are not affected. Not exercising a right on our part will not constitute a waiver. You cannot delegate your rights without our consent. We will not be liable for force majeure events.

14.3 Third Parties: These Terms do not typically confer rights upon third parties, except where specified or where the law does so (e.g., regulators, beneficiaries).

By agreeing to the terms of Pay&Go, you confirm that you:

Have read, understood, and agree to these Terms;

Have the legal capacity to enter into this agreement;

Are aware of the risks associated with digital payments;

Understand and accept our Privacy Policy and governing laws/regulations; and

Agree to check these Terms periodically for amendments.
